Senate Democrats are threatening to filibuster a new Supreme Court nominee no matter who is named. This presents a major problem for Senator Heidi Heitkamp (D-ND). After all, last year Senator Heitkamp said that the Senate needed to “do our job” when it came to the Supreme Court:

“And so, the people of North Dakota and I think the people of this country have a simple message: they want us to do our job. They’re sick and tired of politics getting in the way, of work getting done and they don’t understand why even the most basic issues, the most simple issues, issues where there is vast majorities that support them get hung up in partisan politics.”

Senator Heitkamp was also completely clear when speaking about the disadvantages of a 4-4 Supreme Court. In fact, she warned that a deadlocked court prevented the United States from being a “functioning democracy”:

“But beyond that, the judiciary is an incredibly important part of our checks and balances. and when we don’t have a functioning judiciary, we do not have a functioning democracy.”

If Senator Heitkamp joins with liberal DC activists to filibuster a Supreme Court nominee, she will have abrogated her responsibilities, as the Senator herself has defined them.
